These Terms of Service (the “Terms”) govern your access to and use of GiftMatch Compass, a career-discovery web application operated by GiftMatch Compass (“GiftMatch Compass,” “we,” “us”). By creating an account, clicking “I agree,” or otherwise using the service, you agree to these Terms and to the Privacy Policy, which is incorporated by reference.
You may create an individual account if you are at least 13 years old. Users between 13 and 17 must have permission from a parent, legal guardian, or a school acting in loco parentis under an institutional agreement with GiftMatch. Children under 13 may not create an account directly; schools and parents may onboard younger users only through a signed agreement that provides verifiable parental consent consistent with the Children’s Online Privacy Protection Act (“COPPA,” 15 U.S.C. §§ 6501–6506).
You are responsible for the accuracy of the information in your account and for maintaining the confidentiality of your password. You may not share credentials or allow another person to use your account.
Where a school, school district, college, or other educational institution (a “School”) licenses GiftMatch Compass for its students, the School’s written agreement with GiftMatch controls and supersedes any conflicting provision in these Terms. For student users made available to GiftMatch by a School:
Individual users who believe they are signing up under a School license should confirm eligibility with their School before agreeing to these Terms.
GiftMatch Compass provides a personality-trait assessment, an archetype profile, personalized career matches and deep dives, and related content. Career content blends (i) AI-generated narrative and (ii) citations to public career-outlook data published by the U.S. government. The service is an informational decision-support tool. It is not professional career, legal, financial, educational, psychological, or medical advice, and it does not guarantee any employment, salary, admission, or outcome.
Core features are free. Paid “Pro” features and “Site License” plans are sold through our payment processor, Paddle.com Market Limited (“Paddle”), which acts as the merchant of record. When you subscribe, Paddle’s terms and refund policy also apply to the transaction. Recurring subscriptions renew automatically until cancelled. You can cancel at any time from your account; cancellation takes effect at the end of the current paid period and no refunds are issued for partial periods except where required by law. Prices, features, and plan structures may change; we will give reasonable notice of material changes to paid plans.
You may submit content to the service, including quiz responses, resume text, experience entries, and feedback (“User Content”). You retain ownership of your User Content. You grant GiftMatch a worldwide, non-exclusive, royalty-free license to host, process, display, and use your User Content solely to operate, secure, and improve the service and to generate your personalized output. We do not sell User Content.
You represent that your User Content does not violate anyone else’s rights and that you have the right to submit it. Do not upload sensitive information that is not necessary for the service (for example, government identifiers, medical records, or other people’s personal information).
Narrative content (your compass narrative, career fit explanations, day-in-the-life passages, reflections, and similar text) is generated by third-party large language models, including models operated by OpenAI and Anthropic. AI output can be wrong, incomplete, or out of date. Verify any number, URL, credential, or claim that matters before acting on it. Do not rely on AI output as a substitute for professional advice.
Salary, employment, and occupation data cited on career cards is drawn from U.S. federal sources, principally the U.S. Bureau of Labor Statistics and the O*NET® program. Federal content is in the public domain under 17 U.S.C. § 105 and, where not already proactively published, is obtainable under the Freedom of Information Act (5 U.S.C. § 552). O*NET® content is used under the Creative Commons Attribution 4.0 International license (CC BY 4.0); O*NET® is a trademark of the U.S. Department of Labor, Employment and Training Administration. Third-party names, logos, and trademarks referenced on career cards are the property of their respective owners; references are nominative only and do not imply affiliation or endorsement. You agree not to: (a) access the service by any means other than our provided interfaces; (b) reverse engineer, scrape at scale, or use automated agents to harvest content beyond what a normal user would generate; (c) republish or resell GiftMatch-generated content except for personal, non-commercial use; (d) upload unlawful, infringing, harassing, or malicious content; (e) use the service to impersonate others or to collect information about minors without authorization; or (f) attempt to bypass rate limits, billing controls, or security features.
The GiftMatch name, logo, site design, trait taxonomy, archetype library, assessment questions, scoring logic, and generated narrative templates are owned by GiftMatch or its licensors and are protected by U.S. and international copyright and trademark law. We grant you a limited, non-transferable, revocable license to use the service for your personal (or School-authorized) use. All rights not expressly granted are reserved.
The service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the service will be uninterrupted, secure, error-free, or that any AI output or cited URL will be accurate or current.
To the maximum extent permitted by law, GiftMatch and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, lost data, or lost goodwill arising out of or related to your use of the service, even if we have been advised of the possibility of such damages. Our aggregate liability for any claim will not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim or (b) one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
You will defend, indemnify, and hold GiftMatch harmless from any third-party claim arising out of your User Content, your breach of these Terms, or your misuse of the service, except to the extent caused by our own fault.
You may stop using the service and delete your account at any time by contacting us. We may suspend or terminate your account if you materially breach these Terms, if required by law, or if continuing to provide you the service creates a security or legal risk. Sections that by their nature should survive termination (for example, Sections 6, 10, 11, 12, 13, and 16) will survive.
We may update these Terms as the service evolves. When we make material changes, we will revise the “Last updated” date and, where appropriate, provide additional notice (for example, by email or in-app notice). Your continued use of the service after the effective date of a change means you accept the updated Terms.
These Terms are governed by the laws of the State where GiftMatch Compass is primarily based, without regard to conflict-of-laws principles. Subject to any binding arbitration agreement, you and GiftMatch Compass agree to the exclusive jurisdiction of the state and federal courts located in that State for any dispute not resolved informally.
